Bhardwaj snubs CEC, backs Chawla

New Delhi: Union Law Minister HR Bhardwaj has backed Election Commissioner Navin Chawla in his battle with Chief Election Commissioner N Gopalaswami.

Bhardwaj's statement in support of Chawla and asking Gopalaswami to "do his work in EC and not become a political boss" is a clear indication that the Union Government has decided to reject the CEC’s recommendation to President Pratibha Patil for the removal of Chawla as Election Commissioner.

"Gopalaswami should do his work in EC and not become a political boss. The CEC's power is only to conduct to free and fair elections and he should work in cooperation with his colleagues," the minister said.

CEC should not act like 'political boss': Law Minister

"The CEC has no Constitutional authority to embarrass or comment upon his own colleague because they are all equals, he is only the administrative head of the Election Commission and he is not the boss. They are paid equal salaries, their status is equal and they are complementary to each other," the minister said.

"It is a surprising way of saying that ‘I (CEC) am the authority to recommend’. His authority flows from the President and his opinion is sought on matters related to removal of an Election Commissioner. If the President asks for his opinion he can give. If he (president) does not ask how can he (CEC) say?" the law minister asked.  

Bhardwaj said he had received a file on the matter. "I have to see what is new in the matter," he said, adding the internal tussle within the Election Commission has been going on ever since Chawla was appointed as Election Commissioner.

Chawla: Why should I resign?

The minister also said that after Gopalaswami retires on April 20, Chawla would be the CEC as per precedent. He said the government had a policy to have the senior most Election Commissioner as the CEC and "our policy continues to be the same”.

"It is rather unfortunate that when the country is preparing for general elections, such a controversy has been sparked off by him (CEC)," Bhardwaj said, clarifying that a suo motu recommendation by the CEC to the President for removal of a commissioner cannot be done.

The CEC has caused "embarrassment" with his comment on his colleague because they (all election commissioners) are equals, he said.

What else can you expect from a Govt. completely controlled by Sonia Gandhi who herself is incompetent/and is solely guided by coterie around her.She has reduced Indian State to such mediocre level that we will only get guys who will make mockery of constitution by interfering with institutions like Election commission who are one of the last hopes alongwith Supreme court.Law minister Bhardwaj is a puppet of Sonia and has habit of putting foot in mouth like other parasites/incompetent ministers like Antulay, Arjun singh.Even our present President does not inspire at all as she is no match with persons like Dr. Rajendra Prasad, Dr. Radhakrishnan, Dr. Jakir Hussain, Dr. Kalam who were person of eminence and had their own brains.This is another example of Sonia's way of working of appointing Mediocre people who will be subservient to her.Even she would not defend honest person like presene CEC and would side with CORRUPT Chawla.

I think this report is incomplete. It does not report where is Mr. Bhardwaj contesting his elections from, what is demographic profile of his constituency and more importantly, the book of constitution is a waste of paper and ink by expert idiots of past. Who follows the constitution besides tax payers?

The law minister Mr. Bhardwaj has cross his limit! Him and CEC Mr. Swami both are working for the President , Union of India. When CEC is writting to his boss, there is no need to gang up on him by other employees. Mr. Bahrdwaj actually owe appology to CEC. Just like law ministry is Mr. Bhardwaj resposibility, the EC is responsiblity of Mr. Swami, and he can talk whatever he think right to President as she is not a partisan person. It is her duty to see that election are fare and impartial, and CEC is the person who she is trusting for such purpose and not Mr. Bhardwaj.

One thing is clear from the statements from Congress and its supporters that Navin Chawla will continue in spite of his tract record of "partisan" and the excesses he has done during "Emergency". I am not sure if any one who is giving statements in support of Navin Chawal has ever read or tried to analyse what are the grounds under which Mr. N.Gopalaswami has stated and whether it is true or not. Let there be a committee of experts from the field of Educationalists, Solicitors, Bureaucrats, and media experts who have tract record of "honesty" in their field of work and decide what is the truth behind these "recommendations"? Politicians are bound to favour a person's loyalty to a particular political ideology. I am not saying a particular Political party. I think when there is matter referred to the nations highest office of honour then Let the President decide by way of asking the opinions of Nations experts on this issue. If the Congress leaders tries to "budge" the issue by simply ignoring the recommendations then this amounts to 'Authoritarian Rule". In such cases why should we have offical procedures and why should one elect the President, if he/she is not allowed to investigate the complaints against the officials? If Mr. Navind Chawla has a good tract record then experts will exonerate him and he can hold his head high. Please for the sake of nation let the law take its precedence and not the Loyalty of an official to any political party. Dr. Ambekar.
